1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the website neonlink.ai (the "Site"), operated by Neon Link LLC, an Arizona limited liability company ("Neon Link", "we", "us", or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. The Site is not the service agreement

The Site describes our managed back office services and publishes our standard rates. Actual service engagements are governed exclusively by a separately signed written agreement between Neon Link and the client, such as a Master Services Agreement and Statement of Work. Nothing on the Site, including published rates, quotes generated by our tools, or plans emailed to you, creates a binding service commitment by either party. Published rates are current standard pricing and may change; a rate becomes fixed for you only in a signed agreement or in a written quote we send you that states its own validity period.

3. Quotes and the AI planning tool

The Site includes tools that generate estimated pricing and suggested team configurations, including a tool that drafts a plan from a description you provide using AI. These outputs are automated estimates for discussion purposes. They are generated without human review, may contain errors, and are not professional, legal, financial, or staffing advice. We are happy to confirm any number from the Site in writing; until we do, tool output is informational only. Do not submit confidential information or sensitive personal information through these tools.

4. Who may use the Site

You must be at least 18 years old and able to form a binding contract to use the Site, including submitting a job application or booking a call.

5. Job applications

Submitting an application through the Site does not create an employment relationship, an engagement, or any obligation on either side. You are responsible for the accuracy of the information you submit. How we handle applicant information is described in our Privacy Policy.

6. Intellectual property

The Site and its contents, including text, design, graphics, logos, and software, are owned by Neon Link or its licensors and are protected by United States and international intellectual property laws. "Neon Link" and our logo are trademarks of Neon Link LLC. We grant you a limited, revocable, non-exclusive license to access and use the Site for its intended purpose. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Site without our prior written consent, except as permitted by law.

If you send us ideas or feedback about the Site or our services, you agree we may use them without restriction or compensation.

7. Acceptable use

You agree not to:

• Use the Site in any way that violates applicable law.
• Use bots, scrapers, or other automated means to access the Site or harvest data from it, except for standard search engine indexing and the read-only public data interfaces we intentionally publish.
• Submit false, misleading, or infringing content through our forms or tools.
• Attempt to probe, disrupt, overload, or gain unauthorized access to the Site or its infrastructure.
• Use our forms, tools, or email addresses to send spam or malicious content.

8. Third party services

The Site links to and embeds services operated by third parties, including our scheduling provider and social platforms. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third party services.

9. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION ON THE SITE, INCLUDING PRICING AND TOOL OUTPUT, IS ACCURATE, COMPLETE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEON LINK AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND IT DOES NOT APPLY TO ANY SIGNED SERVICE AGREEMENT, WHICH CONTAINS ITS OWN TERMS.

11. Indemnification

You agree to indemnify and hold harmless Neon Link and its members, managers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

12. Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction and venue there.

13. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date and applies from the moment it is posted. Continuing to use the Site after an update means you accept the updated Terms.

14. General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and Neon Link about the Site itself.
